Eligibility Rules

  • Primary buyer rule: The first name on the sale deed must be a woman. A husband can be the second name (co-buyer) and the property still qualifies for the 5% rate.
  • Joint purchase with spouse: Qualifies. Put the wife's name first on the agreement and the entire stamp is calculated at 4% (plus 1% metro cess).
  • NRI women: Qualify on the same terms. Repatriation and FEMA rules for NRI purchases are separate from the stamp rebate and do not affect eligibility.
  • Multiple properties: The rebate applies to each property independently. A woman who already owns a property can claim the rebate on a second purchase in Maharashtra.
  • Company or HUF purchase: Does not qualify. The rebate is for individual women buyers only.

Process

At the time of registration at the Sub-Registrar office, the first buyer named on the agreement is identified as female.
